Paul Ryan (R-WI) is holding the government hostage in exchange for control of every uterus in America

Paul Ryan (R-WI) is holding the government hostage in exchange for control of every uterus in America
Since negotiations to avert a national default on the debt have shifted from the House to the Senate, Republicans in the lower chamber are still hoping to use the talks as “leverage” to limit women’s access to contraception.

According to the Washington Post, in a private meeting with House Republicans Rep. Paul Ryan (R-WI) — who earlier this weak floated a compromise that would raise the debt ceiling in exchange for cuts to entitlement programs — railed against emerging Senate proposals and argued that the “House could not accept either a debt-limit bill or a government-funding measure that would delay the next fight until the new year”:

According to two Republicans familiar with the exchange, Ryan argued that the House would need those deadlines as “leverage” for delaying the health-care law’s individual mandate and adding a “conscience clause” — allowing employers and insurers to opt out of birth-control coverage if they find it objectionable on moral or religious grounds — and mentioned tax and entitlement goals Ryan had focused on in a recent op-ed in the Wall Street Journal.

Ryan’s speech appeared only to further rile up the conservative wing of the GOP conference, which has been agitating the shutdown strategy to try to tear apart the health-care law.

The Affordable Care Act stipulates that employers and insurers must provide no-cost contraception coverage as part of their health care plans and exempts churches and religious nonprofits that primarily employ people of the same faith from the requirement. In a compromise between Catholic groups and the White House, religiously affiliated colleges, universities, and hospitals that wish to avoid providing birth control can also opt out of offering the benefits, while their employees receive contraception coverage at no additional cost sharing directly from the insurer.

Republicans, however, are not satisfied with the accommodation and have tried to expand the so-called conscience clause, permitting any employer or insurance plan to exclude health services, no matter how essential, from coverage if they morally object to it.

In the last week of budget negotiations, some in the GOP have walked back their demand to fully defund the Affordable Care Act and have instead offered relatively small changes to the Affordable Care Act. But Senate Majority Leader Harry Reid (D-NV), who is now leading the negotiations with Sen. Mitch McConnell (R-KY) and the White House, insists that changes to the health care law are off the table.

By all means let's have a “conscience clause” for everything: you're vegetarian, then using the conservative view on conscience you can deny your employees that part of their paycheck they spend on meat. If you are a catholic employer you can pay your Protestant and Jewish employees less because their religion is morally objectionable. According to conservative "conscience" if you do not approve of drinking beer, you can refuse to insure anyone who drinks beer. When conservatives say they're for "personal "freedom" they're just joking. What they believe in is the freedom to impose every weirdo freaky thing they believe in on everyone else - kind of like the Communist party in China or the rulers of Iran.

Evil is Restless, Monsanto's Next Target is the Destruction of American Democracy

Evil is Restless, Monsanto's Next Target is the Destruction of American Democracy

Big Food’s greatest fear is materializing. A critical mass of educated consumers, food and natural health activists are organizing a powerful movement that could well overthrow North America’s trillion-dollar junk food empire. Savvy and more determined than ever, activists are zeroing in on the Achilles heel of Food Inc. -- labeling.

But as consumers demand truth and greater transparency in labeling, it isn’t just Big Food whose empire is vulnerable. The biotech industry, which makes billions supplying junk food manufacturers with cheap, genetically engineered (GE) ingredients, has even more to lose. Monsanto knows that if food producers are forced to label the genetically modified organisms (GMOs) in their food products, they’ll reformulate those products to meet consumer demand for GMO-free alternatives. That’s why companies like Monsanto, DuPont and Dow, along with Coca-Cola and Pepsi, last year spent more than $46 million to defeat Proposition 37, California’s GMO labeling initiative.

The junk food and biotech industries narrowly (48.5% - 51.5%) prevailed in California, but they know it’s only a matter of time before one or more states pass a mandatory GMO labeling law. More than 30 state legislatures are now debating GMO labeling bills. And consumers have broadened the fight [4] beyond just labeling. Five counties and two cities in California and Washington have banned the growing of GE crops. In addition, given the near total absence of FDA regulation, 19 states have passed laws restricting GMOs [4].

How is the biotech industry fighting back? By attacking democracy.  Experts say the laws are on the side of consumers. But consumers will no doubt still have to defend democracy against an increasingly desperate, and aggressive, industry bent on protecting the highly profitable business of genetically engineered food.

The battle lines have been drawn. Will we cede our food sovereignty rights to a profit-at-all costs corporatocracy?

Monsanto’s lobbyists are out in force in Washington, Vermont, Connecticut, and several dozen other states. They’re lobbying politicians behind the scenes and planting misleading articles [5] in the press. Attacking pro-labeling anti-GMO proponents as anti-technology Luddites.  They’re repeating ad nauseum their propaganda claims that GE foods and crops are perfectly safe and therefore need no labeling, that transgenics are environment- and climate-friendly, and that genetically modified crops are necessary to feed the world.

One of Monsanto’s major propaganda points, designed to discourage state officials from passing GMO labeling laws, is that state GMO labeling is unconstitutional. Monsanto has repeatedly stated that it will sue any state that dares to label. This threat of a lawsuit was enough to convince lawmakers in Vermont and Connecticut in 2012 to back off [6] from labeling, even though there were sufficient votes, and overwhelming public sentiment, to pass these bills.

The same scenario [7] is unfolding again [7] in Vermont, where the Governor is refusing to endorse a popular labeling bill that could easily pass through both houses of the legislature.

Biotech industry lawyers claim that Federal courts will strike down mandatory state GMO labeling for three reasons: 1)because Federal law, in this case FDA regulations, preempts state law; 2) because commercial free speech allows corporations to remain silent on whether or not their products are genetically engineered and; 3) because GMO labeling would interfere with interstate commerce.

These claims simply don’t hold up. State GMO labeling, and other food safety and food labeling laws, are constitutional. Federal law, upheld for decades by federal court legal decisions, allows states to pass laws relating food safety or food labels when the FDA has no prior regulations or prohibitions in place. There is currently no federal law or FDA regulation on GMO labeling, except for a guidance statement on voluntary labeling, nor is there any federal prohibition on state GMO or other food safety labeling laws. In fact there are over 200 state food labeling laws in effect right now in the U.S., including a GMO fish labeling law in Alaska, laws on labeling wild rice, maple syrup, dairy quality, kosher products, and laws on labeling dairy products as rBGH-free. It is very unlikely that any federal court will want to make a sweeping ruling that would nullify 200 preexisting state laws.

U.S. case law does indicate that commercial free speech in certain instances allows corporations to remain silent about what’s in their products. However federal courts have consistently ruled that when there are compelling state interests -- health, environment, economic -- states can require corporations to divulge what’s in their products or how they were produced.

When it comes to GMOs, states can clearly make the case for compelling state interests, according to Consumer Union’s senior scientist, Michael Hansen. Hansen says: “...there is a compelling state interest in labeling of genetically engineered foods and that is due to the potential human health and environmental impacts of genetically engineered foods.”

Hansen also argues that Codex Alimentarius,  a collection of internationally recognized standards, codes of practice, guidelines and other recommendations relating to foods, food production and food safety, guarantees nations the right to implement mandatory labeling of GMO foods. The standards support the argument that GMO labels do not constitute a restriction of free trade, as long as they are applied to both domestic and international producers.  Similarly state GMO labels, as long as they do not discriminate against particular producers, but rather apply to all producers -- state, national, and international -- do not constitute a restriction of interstate commerce.

The U.S. government, under massive global pressure, has signed on to the Codex Alimentarius, which serves "as a risk management measure to deal with the scientific uncertainty" associated with genetically engineered foods. And according to Hansen, there most certainly is significant scientific uncertainty [8] about the potential health impacts of genetically engineered foods.”

States and localities have the right and the power to pass their own legislation, especially when the federal government fails or refuses to act on matters of compelling interest. Although large corporations now control the federal government, we still have room to organize and govern ourselves, especially at the local level.

“Home rule,” embedded in state constitutions and municipal charters across the U.S., provides the legal basis that has enabled several hundred cities and counties to pass ordinances banning factory farms, the spreading of sewage sludge on farmlands, fracking (which pollutes groundwater, farms and gardens), and even GMOs.

Yet undeterred by 200 years of case law and legislation institutionalizing states’ rights and local “Home Rule,” corporations are brazenly attacking the rights of states and localities to regulate Corporate America’s often reckless and criminal behavior.  They’re getting help from the infamous pro-corporate lobbying group, the American Legislative Exchange Council (ALEC). ALEC [9]is lobbying states across the country to restrict counties or local governments from passing any laws limiting pesticide use, GMOs, fracking, or industrial agriculture practices.
So corporations do not have human rights, they have super human rights. or so they seem to think. Let's say that all genetically modified foods are safe, how could labeling them - thus giving people a choice interfere with Monsanto's ability to do business. That is unless they know that some people do not want to gamble their lives or the lives of their children on what a corporation says is safe.

The Republican March In North Dakota To Have Tyrannical Government Control of Women's Bodies

The Republican March In North Dakota To Have Tyrannical Government Control of Women's Bodies

On Tuesday afternoon, North Dakota Gov. Jack Dalrymple (R) signed into law three different abortion restrictions — HB 1305, HB 1456, and SB 2305 — that women’s health advocates say will effectively ban abortion in the state. The extreme legislation that has received the most media attention is HB 1456, an unconstitutional “fetal heartbeat” ban that would outlaw abortions after just six weeks of pregnancy, before many women even realize they’re pregnant. But when it comes to the new laws’ concrete effect on the lives of women in North Dakota, a lesser-known piece of legislation may actually pose an even bigger threat to reproductive rights.

North Dakota women will feel the immediate impact of SB 2305, which indirectly targets abortion access by over-regulating abortion providers — a popular anti-choice tactic known as the Targeted Regulation of Abortion Providers, or TRAP. Abortion opponents push TRAP laws with the ultimate goal of forcing abortion clinics to close their doors.

TRAP laws are cleverly framed in terms of ensuring women’s safety, but they’re actually incredibly effective methods of cutting off access to reproductive care at health clinics. That’s why Tammi Kromenaker, the director of North Dakota’s last remaining abortion clinic, told RH Reality Check that SB 2305 could actually represent the most serious threat to women’s abortion services in the state:

“We definitely see the TRAP bill as the one that will end abortion in the state,” Tammi Kromenaker, the director of Red River Women’s Clinic (RRWC), told RH Reality Check. RRWC is the only abortion clinic in North Dakota. “The other bills aren’t really a threat right now, but this one could close us.” [...]

These bills have drawn attention away from the true threat to RRWC: Under the new TRAP bill, abortion providers would be forced to obtain hospital admitting privileges. But at least one of the two local hospitals won’t offer those privileges to the clinic — because the quality of care at RRWC is so high that the clinic doesn’t need them.

Lawmakers proposed the bill under the guise of “women’s safety,” but Kromenaker points out that her clinic’s safety record is actually better than the average clinic safety records, showing that the “need” for the bill was completely fabricated. “This bill is intended to impose an impossible to meet requirement,” she said. “There is no other goal but to shut us down.”

North Dakota’s new six-week ban will likely be tied up in court for going much too far to undermine the constitutional protections in Roe v. Wade, which guarantees the right to first-trimester abortion services. And an even more radical “personhood” amendment, which could ban all abortions altogether if voters approve it on the 2014 November ballot, will face similar legal challenges if it becomes law. On the other hand, SB 2305 could force the Red River Women’s Clinic to close its doors relatively quickly — just like similar legislation has done to health clinics in other states.

Conservatives have some very creepy ideas about rights, children and women. As long as someone is a possible person, a clump of cells, they're all for the protection of that abstraction - going so far as to have the government make personal health care choices for individuals and their families. On the other hand they actively despise women, hate the idea of helping children with health care or education. And they're happy to use government to make sure that corporations have more power then women or children. Whatever values Republicans have, they're not patriotic American values.

Gov. Nikki Haley Appoints Radical Anti-American Proto-Fascist Tim Scott, to Replace Wacko Sen. Jim DeMint (R-SC)

Gov. Nikki Haley Appoints Radical Anti-American Proto-Fascist Tim Scott, to Replace Wacko Sen. Jim DeMint (R-SC)

Tim Scott is America’s newest senator today after getting tapped by South Carolina Gov. Nikki Haley (R) to fill the vacancy left by former Sen. Jim DeMint (R-SC). DeMint announced this month that he was leaving the Senate to head up the Heritage Foundation, an arch-conservative think tank in Washington DC.

Though DeMint left big, controversial shoes to fill for Republicans, few conservatives will be disappointed with Scott’s record. Elected to Congress just two years ago in the Tea Party wave, Scott has already garnered headlines for his plan to impeach President Obama, his legislation to cut off union members’ children from food stamps, and his defense of Big Oil.

Here’s a quick look at Scott’s record:

Floated impeaching Obama over the debt ceiling. As the debt ceiling debate raged in the summer of 2011 because of the intransigence of Tea Party freshmen like Scott, the nation inched perilously close to defaulting on its obligations. One option discussed by some officials to avoid that scenario was for the president to assert that the debt ceiling itself was an unconstitutional infringement on the 14th Amendment. However, Tim Scott told a South Carolina Tea Party group that if Obama were to go this route, it would be an “impeachable act.”

Proposed a bill to cut off food stamps for entire families if one member went on strike. One of the most anti-union members of Congress, Scott proposed a bill two months after entering Congress in 2011 to kick families off food stamps if one adult were participating in a strike. Scott’s legislation made no exception for children or other dependents.

Wanted to spend an unlimited amount of money to display Ten Commandments outside county building. When Scott was on the Charleston County Council, one of his primary issues was displaying the Ten Commandments outside the Council building. According to the Augusta Chronicle, Scott said the display “would remind council members and speakers the moral absolutes they should follow.” When he was sued for violating the Constitution and a Circuit Judge’s orders, Scott was nonplussed: “Whatever it costs in the pursuit of this goal (of displaying the Commandments) is worth it.”

Defended fairness of giving billions in subsidies to Big Oil. Scott and his Republican allies in Congress voted repeatedly last year to protect more than $50 billion in taxpayer subsidies for Big Oil corporations. When ThinkProgress asked Scott whether it was fair to do that, especially at a time when oil companies are earning tens of billions in profit every quarter, the Tea Party freshman defended the industry: “fair is a relative word,” said Scott.

Helped slash South Carolina’s HIV/AIDS budget. As a state representative, Scott backed a proposal to cut the state’s entire HIV/AIDS budget, despite the fact that South Carolina ranks in the top-third of reported AIDS cases. The cuts were ultimately included in the state’s budget, impacting more than 2,000 HIV-positive South Carolinians who needed help paying for their medication.
So Scott is against every ideal America stands for: Scott is part of the conservative Taliban and is against separation of church and state, like the European fascists of the 1930s Scott is a social-Darwinist, he likes the ten commandments but hates the teachings of Jesus and the virtue of charity preached by Founders like Benjamin Franklin, Scott hates people simply because they are ill and is happy to withhold medical care. Yep, he is just a Jim Demint clone, an America hating zealot.

5 Lies The Gun Lobby Tells You

MYTH #2: The Second Amendment prohibits strict gun control.  While the Supreme Court ruled in  D.C. v. Heller  that bans on handgun ownership were unconstitutional, the ruling gives the state and federal governments a great deal of latitude to regulate that gun ownership as they choose. As the U.S. Second Court of Appeals  put it in a recent ruling  upholding a New York regulation, “The state’s ability to regulate firearms and, for that matter, conduct, is qualitatively different in public than in the home. Heller reinforces this view. In striking D.C.’s handgun ban, the Court stressed that banning usable handguns in the home is a ‘policy choice‘ that is ‘off the table,’ but that a variety of other regulatory options remain available, including categorical bans on firearm possession in certain public locations.”
Amazingly people can support the 2nd amendment and some reasonable gun control at the same time.
